Draft for legal review: text in [brackets] is to be completed before launch.
This Disclaimer explains the limits of what ECCS's services, app, scores and pages mean. It is part of our Terms of Service and applies to everyone who uses the app or reads a customer page.
1. We are a private company
ECCS (Eosfera Commercial Cleaning Solutions) is the trading name of [Registered company name], a private business. Restaurants pay us for our services.
We are not the Food Safety and Standards Authority of India (FSSAI), TG-SAFE (Telangana's food and drugs authority), a municipal body or any other government body, and we are not associated with, approved by or acting for any of them. We are not an FSSAI-recognised hygiene rating audit agency.
2. Our score, inspections and grades are our own
- The hygiene score is ECCS's own score out of 100. It adds up to 60 points from our latest inspection, up to 30 from the outlet's daily checklists and up to 10 from its licence records.
- Our inspections, inspection scores and grades (A+, A and B) follow our own checklist and method.
- None of these is a government rating, and none is the FSSAI Hygiene Rating. FSSAI's own scheme is carried out by agencies it recognises and uses its own scale.
- A score or grade reflects what we saw, and what the outlet recorded, at a point in time. Conditions can change the next day.
- The checklist part of the score depends on records the restaurant's own staff make. We flag doubtful proof photos, but we cannot check every record.
3. What we do not guarantee
We do not guarantee, and nothing in the app, a report, a certificate or a score means, that:
- an outlet complies with the Food Safety and Standards Act, 2006 or any other law;
- its licences or registrations are valid, complete or up to date;
- it will pass an inspection by a food safety officer or any authority, or receive any official rating;
- its food is safe, or that no illness, contamination or pest problem will happen;
- a service will give a lasting result after our team leaves.
Cleaning, pest control, tests and inspections reduce risks; they cannot remove them.
4. The restaurant remains responsible
Each restaurant remains fully responsible for its own legal duties, including food safety, hygiene, licences, staff health and training, labour law and tax. Using ECCS does not transfer any of these duties to us.
5. Guidance is general information, not legal advice
Our SOP library, checklists, reminders, training material and other guidance are general information to help kitchens work hygienically. They are not legal advice and may not cover every situation or the latest change in the law. For advice on your own legal position, consult a qualified professional or the relevant authority. Licence expiry reminders depend on the details you enter in the app.
6. The customer page
- A customer page is published only if the restaurant's Owner switches it on, and we can take it down.
- It shows yesterday's hygiene score, the names of the daily checklists and whether each was done, photos the restaurant chose and we approved, our latest inspection result and recent services. A photo is shown for at most 90 days, and an inspection result for at most 180 days.
- It is a private assessment by ECCS, a private company paid by the restaurant. It is not a government rating or certificate, and ECCS is not associated with FSSAI, TG-SAFE or any government body.
- Diners should use it as one piece of information among others, not as a guarantee.
7. The vendor directory is not an endorsement
The vendor directory lists food vendors and distributors near a restaurant to save time. We do not check, approve, recommend or vouch for any vendor, their goods, prices, hygiene or licences. Each vendor's FSSAI number is shown as the vendor gave it; check it on FSSAI's FoSCoS website before relying on it. Any purchase is between the restaurant and the vendor. Entries marked as samples are examples, not real businesses.
8. Partners and links to other websites
- Some services are delivered with ECCS partners, such as laboratories, training providers and medical camp providers. The app says when a partner is involved. A partner's test results, certificates and professional findings are the partner's own work. Our Terms of Service explain what we are responsible for.
- The app and our pages may link to other websites, such as FSSAI's website or a payment provider's pages. We do not control them and are not responsible for their content or their privacy practices.
9. Limits of liability
Our responsibility for our services and the app is set out, and limited, in our Terms of Service. Nothing in this Disclaimer limits any right that the law says cannot be limited.
